These Terms & Conditions (“Terms”) govern your access to and use of the Aracari Healing website at https://www.aracarihealing.com (the “Site”).

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Notice. If you do not agree, do not use the Site.

Use of the site

  • The Site is provided for general informational and educational purposes about CR Neuropsychology’s neuropsychological, psychotherapy, and related professional services.

  • You agree to use the Site only for lawful purposes and in a manner consistent with all applicable laws and regulations.

  • You agree not to attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site, through hacking, password mining, or any other means.

No medical or psychological advice

  • The information presented on the Site is for general information only and is not intended to provide medical, psychological, neuropsychological, or other professional advice, diagnosis, or treatment.

  • Use of the Site does not create a doctor–patient or psychologist–patient relationship between you and Aracari Healing or any of its clinicians.​

  • You should not disregard professional medical or psychological advice or delay seeking it because of something you have read on the Site. Always seek the advice of your physician, psychologist, or other qualified health provider with any questions you may have regarding a medical or mental health condition.

Not for emergencies

The Site and any email or online contact forms are not intended for use in emergencies or crisis situations.

  • If you are experiencing a medical or mental health emergency, call 911 or your local emergency number, or go to the nearest emergency room or crisis center immediately.

  • Aracari Healing cannot guarantee timely responses to messages submitted through the Site and does not monitor the Site for emergency communications.

Intellectual property

  • All content on the Site, including text, graphics, logos, images, and design, is owned by or licensed to CR Neuropsychology and is protected by copyright, trademark, and other intellectual property laws, except where otherwise noted.

  • You may view, download, and print content from the Site for your personal, noncommercial use only, provided you do not remove any copyright or other proprietary notices.

  • You may not modify, reproduce, distribute, publicly display, create derivative works from, or use any content from the Site for commercial purposes without our prior written permission.

User submissions

If you submit information, questions, feedback, or other materials through the Site:

  • You are responsible for the content and accuracy of the information you submit.

  • You agree not to submit any unlawful, threatening, defamatory, obscene, or otherwise inappropriate material.

  • Non-patient submissions that do not contain protected health information may be used by us for any lawful purpose, consistent with our Privacy Notice and applicable law.

Third-party links

The Site may include links to third-party websites or resources for your convenience.

  • Aracari Healing does not endorse and is not responsible or liable for any content, products, or services on or available from those third-party sites or resources.

  • Your use of third-party websites is at your own risk and subject to the terms and policies of those websites.

Disclaimers

  • The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

  • To the fullest extent permitted by law, Aracari Healing disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

  • CR Neuropsychology does not warrant that the Site will be uninterrupted, secure, or error‑free, or that defects will be corrected.

Limitation of liability

To the fullest extent permitted by law:

  • CR Neuropsychology and its clinicians, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of, or inability to use, the Site.

  • Our total liability for any claim arising out of or relating to the Site shall not exceed one hundred U.S. dollars (US$100), even if a remedy set forth in these Terms is found to have failed of its essential purpose.

Indemnification

You agree to indemnify, defend, and hold harmless Aracari Healing and its clinicians, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

Governing law and jurisdiction

These Terms and your use of the Site are governed by the laws of the Commonwealth of Massachusetts, without giving effect to any choice or conflict of law provision.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the state or federal courts located in Massachusetts, and you consent to jurisdiction in such courts.

Changes to these Terms

We may revise and update these Terms from time to time.

All changes are effective when posted on the Site, and your continued use of the Site after the posting of revised Terms means you accept and agree to the changes.
